You are still thinking about all the job crap and call. Are you some kind of a retard? Holy shit. What more meets the eye man? He might not be around after sometime. Instead of this bullshit, his priority must be to get better and spend time with family and friends. We dont know how things will be after 6 months. What I find retarded is that this crap green card seems to be taking higher position than him getting better.
To the original poster: Please realize that there is nothing more beautiful than life. Every minute of it is of the essence. Family and loved ones are more important than anything in life. You will not take money, green card or anything after you die. Your wife will be more happy realizing that she spent some fantastic time with you. I wish and pray that you get better. Everybody has been waiting for his/her green card and congratulations to all those who has got their GC. On the other hand it is really unfair and to some extent unethical on the part of USICS not follow a fair system.
There are several people in 2004, 2005 who have been paitently waiting for their turn only to see that people behind them getting approved.
Several of us have writtent to Ombudsman, Director but of no avail.
Not sure what else can be done? Any Idea? Do we have any liaison with AILA who can take up this matter.
Not only this situation , CIS is not fair in many situations.

2.Making Eb2/Eb3 current(July 2007) for the purpose of fees.
3.Substitute labors
4.Giving visa number to spouse(for example not even passed 10th standard) of EB2 applicant , instead of EB3 qualified candidate(for example Computer Science Graduate from reputed universities)
5.Not following PD

My 8 selfish American colleagues almost costed our company a $1.8 million project, simply because they could not cancel their preplanned trip to Bahamas. They went on their trip despite being warned 8 months in advance by our boss about a possible tough period during the critical design review of the project by the customer during the month of December.
My 5 hardworking H1B employees helped us out with the project resource planning,allocation layouts, financial statements, project planning and estimation analysis. 3 of them cancelled their trip to their home country just to save our business.
My boss is absolutely incensed and is going to fire these workers once they come back from their vacation.
Agreed that they are not expected to work more than 40 hours per week but during tough times their should be a certain sense of committment and solidarity towards your employer which was clearly lacking in my American colleagues.
According to my boss the current generation of American college graduates is the laziest he has ever seen and clearly ill equipped to handle tough job assignments during a time of crisis. He is lobbying very hard to get the SKIL bill passed and increase access for American businesses to global talent.

This is not correct from legal point of view. I would put this statement as
-- Must have valid work authorization. Sponsorship for any work visa is not offered.
Employer can not ask for kind of authorization. It could be, EAD, OPT, GC etc. As long as applicant is qualified as per I-9 form, kind of authorization should not matter.
Of course, H-1B applicant can not apply for this job position since visa sponsorship is not available.

I am starting this new thread to discuss about EB visas spillover usage based on oldest priority date irrespective of category/country. Currently the spillover happens vertically(a top down approach) from EB1 -> EB2 -> EB3...etc. Instead it should be first used on cases with oldest priority date. This will not only give a good move to clear the backlog but will also be a fair rule for those who are patiently waiting in queue for a long time. I wrote my concern about this to my local congressman. I also request each one of you, who is impacted by this, or who is interested to help us out, to kindly contact your local congressman/woman to express your concern. In turn they can contact USCIS to implement this fair rule to help us all out.

For those of you joining us late, here is some info about this thread.
1. This is to do our least part to the core IV Team for their selfless sacrifice, for all of us getting the benefits of legal immigration. Note that , Aman Kapoor , the co-founder of IV has done his part by sacrificing $64,000/- from his own personal funds towards the administrative costs of IV. Yes you read it right , it is $64,000/- We come to know from his co-worker that he has sold his house towards running this show for us.
2. We have not yet figured out a way to reimburse these costs as IV does not yet have administrative costs part of the expenditure allocation, as we understand it. So instead of a wait and watch, we decided to go ahead with collecting the pledge from the members on the amount they are putting forth for reimbursing the amount. Once we come up with a strategy(members we look for your suggestions on how to get this done, please add your comments) we will instruct the members pledged to pay out.
So do not pay it directly to the IV core funds, yet.
Please help us spread the message about this thread in other threads by copy and pasting the following in other threads too.

I know many cases like this, people approach these Bodyshoppers to get H1, or to convert H4 to H1..... many pay even H1 processing fees(which is illegal)..... just pray that after getting H1 they will get some project and the employer will pay....... they won't dare to ask employer.... becoz he can just revoke H1 and just be done with it...... many many cases....

Problem with that argument once you own more than 5% of the company you will have file as investor. If your wife owns the company then you will have file under relative category. There were denials based on this.

We want to do some thing for elimination of backlogs Especially for EB3 - India Else we wont see any more progress.

Unless and untill everybody in EB3 has contributed ataleast a $1000.00 to the immigrationvoice cause, its waste of time to discuss about the EB3-India movement. Any way we have to spend a lot more than $1000.00 in renewing EADs, H1Bs and H4s.
Otherwise just wait and pray for the CIR bill to pass. Then every body in the EB category will get the benefit being the EB3- India/China are the greatest benefitters.

I did called NSC IO yesterday and she said that my packet must have been in caught up in the front log.
Looks like all our 485 packets have been xfered to TSC from NSC. Hence SRCXXXXXXXXX
